It's a tricky problem, actually. You don't want governments to be
able to tax religious institutions, since "the
power to tax is the power to destroy," but you don't want
governments to be in the business of defining what constitutes a
religious institution either, except in the broadest of terms. The
default should probably be along the lines of, "something is a
religion if it calls itself a religion"-- and if it does not engage
in activities that are otherwise inimical to the public good. A
light touch is called for in this area: religious bigotry is as
dangerous as religious tyranny.
I'm not sure which one this is, but I'll be surprised if the
decision stands.
